These Terms of Service ("Terms") govern your use of the website, platform, and services provided by 5C Network (India) Private Limited ("Company", "we", "us"), a company incorporated under the Companies Act, 2013, having its registered office at No.313, Mico Employees Gruha Nirmana Sangha, BTM 2nd Stage, Rashtrakavi Kuvempu Nagara, Bengaluru, Karnataka 560076.

By accessing or using our website (www.5cnetwork.com), platform, or any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Services

5C Network provides an AI-native radiology platform that connects healthcare facilities with qualified radiologists for remote radiology reporting. Our services include:

  • Teleradiology reporting across X-ray, CT, MRI, and Mammography modalities
  • AI-assisted diagnostic workflow through our Bionic suite
  • Quality assurance and structured reporting
  • PACS integration and image management
  • 24/7 radiology coverage for healthcare facilities

2. Eligibility

Our services are intended for licensed healthcare facilities, registered medical practitioners, and qualified radiologists. By using our platform, you represent that you have the legal authority to enter into these Terms and comply with all applicable medical regulations.

3. User Accounts

To access certain features of our platform, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring that your registration information is accurate and current

4. Medical Disclaimer

All radiology reports generated through our platform are prepared by qualified, board-certified radiologists (MD/DNB Radiology) registered with their respective State Medical Councils. AI-generated outputs from our Bionic suite are assistive tools only and are always reviewed by a qualified radiologist before delivery.

Our reports are intended to assist the referring physician in clinical decision-making and do not constitute a final clinical diagnosis. The referring physician retains full clinical responsibility for patient management.

5. Intellectual Property

All content, technology, software, AI models, trademarks, and materials on our website and platform are the property of 5C Network (India) Private Limited or its licensors and are protected under applicable intellectual property laws. You may not:

  • Copy, modify, or distribute our content without prior written consent
  • Reverse-engineer, decompile, or attempt to extract source code from our software or AI models
  • Use our trademarks or branding without authorization
  • Scrape, crawl, or harvest data from our platform for commercial purposes without permission

6. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose
  • Submit falsified, misleading, or non-authentic medical data
  • Interfere with or disrupt the platform's infrastructure or security
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use our platform to transmit malware or harmful code

7. Data Protection

Our handling of personal and health information is governed by our Privacy Policy. We comply with the Information Technology Act, 2000, the Telemedicine Practice Guidelines 2020, and maintain ISO 27001 certification for information security management.

8. Service Availability

While we strive to maintain uninterrupted service, we do not guarantee that our platform will be available at all times. We may temporarily suspend access for maintenance, upgrades, or due to circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.

9. Payment Terms

Payment terms for our services are governed by individual service agreements between the Company and each healthcare facility or radiologist. All fees, payment schedules, and billing terms are specified in the applicable service agreement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Company's aggregate liability for any claims arising from or related to these Terms or our services shall be limited to the amount paid by you to the Company in the twelve (12) months preceding the claim, or INR 1,000, whichever is higher.

The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the theory of liability.

11. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

12. Termination

Either party may terminate the service relationship in accordance with the terms of the applicable service agreement. The Company reserves the right to suspend or terminate access to the platform immediately if a user violates these Terms or engages in conduct that may harm the Company, other users, or third parties.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

Before initiating legal proceedings, the parties agree to attempt resolution through good-faith negotiation and, if necessary, mediation.

14. Amendments

The Company reserves the right to modify these Terms at any time. Material changes will be communicated through our website or by email. Continued use of our services after such changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
